Due Diligence Affidavit in California

When personal service cannot be completed after reasonable diligence, California courts require a sworn Due Diligence Affidavit before authorizing substitute service (CCP §415.20) or service by publication (CCP §415.50). Kern County Process Servers provides professionally prepared affidavits accepted by all California courts.

What the Affidavit Documents

  • Date, time, and location of every service attempt
  • Description of the premises and any contact with occupants
  • Investigative steps taken to locate the subject
  • Reason each attempt did not result in service
  • Investigator’s sworn statement under penalty of perjury

How Many Attempts Are Required

California courts generally expect a minimum of three to five attempts on different days and at different times of day before granting substitute service or service by publication. We follow protocols designed to satisfy even the strictest judicial scrutiny.
